This law introduced important protections for breast cancer patients who elect breast reconstruction in connection with a mastectomy. It mandated that all private-sector health plans that cover mastectomies (which are any health plans that provide medical and surgical benefits) cover reconstructive surgery as well. An important, on-going aspect of the Womens Health Act involves the annual notice requirement. This requires that each participant, including single males (as the requirements of the law apply uniformly to females and males alike), who is covered by a plan of health coverage be given a written notification of their rights under the Act each year. This written annual notification may be delivered at any time during the plan year. As we do each year, we are suggesting a January 1st target date as a good, hopefully easy, way to remember to deliver this annual notice. The notices may be provided by first class mail or any other similar means of delivery. In-hand delivery to the employees at his or her worksite is also acceptable; however, placing copies of the notice in a location frequented by participants is not deemed acceptable. You may chose to furnish such notice as a special insert to a company periodical, such as a newsletter, as long as the distribution list is fully comprehensive and up-to-date and a notice on the front page of the newsletter prominently indicates that important information about participants rights under the plan are enclosed and should be read and retained by the participant for future reference. Other options for issuing the annual notice includes adding it to a new SPD, a summary of material modifications, a summary annual report, or open enrollment materials which are given to all plan participants. A copy of a conforming written notification is enclosed for your use. Please provide it to all of your employees, COBRA participants, and, if applicable, retirees who are covered by your health benefit plan. If we handle your COBRA administration for you, we will send a copy of this notice to those persons who are currently active on that coverage. The law mandates that a participant or eligible beneficiary who is receiving benefits for a covered mastectomy and who elects breast reconstruction in connection with the mastectomy, will also receive coverage for: reconstruction of the breast on which the mastectomy has been performed; surgery and reconstruction of the other breast to produce a symmetrical appearance; and prostheses and treatment of physical complications of all states of mastectomy, including lymphedemas.
